Terms of Service

1. Agreement to terms
These Terms of Service (“Terms”) govern your access to and use of BrewerBoard (“BrewerBoard”, “Service”, “we”, “us”), including the BrewerBoard website at brewerboard.com, the BrewerBoard iOS and Android applications, and any related software, content, or services we provide (collectively, the “Service”).
By creating an account, accessing the Service, or using BrewerBoard in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Description of service
BrewerBoard provides software that lets venue operators (such as taprooms, breweries, bars, and restaurants) build and display digital tap lists, slideshows, and other menu content on televisions and other screens. The Service is delivered as a hosted web application with companion mobile apps.
3. Accounts
You may need an account to use parts of the Service. You are responsible for keeping your account credentials confidential and for all activity that happens under your account. You must notify us promptly if you suspect unauthorized access.
You may invite additional team members (e.g., managers) to your account. You are responsible for the actions of users you invite.
4. Your content
You retain all rights to the menu data, images, videos, and other content you upload to the Service (“Your Content”). You grant BrewerBoard a non-exclusive, worldwide license to host, store, transmit, and display Your Content solely to operate the Service for you and the screens you authorize.
You represent that you own or have the rights to use Your Content, including any images, logos, brand assets, video, or third-party content you upload, and that displaying it on the Service will not infringe on anyone else's rights.
5. Acceptable use
You agree not to:
- upload content that is unlawful, infringing, defamatory, or harmful;
- use the Service to display content depicting or promoting violence, hate, sexual content, or illegal activity;
- attempt to access another customer's account or data without permission;
- reverse engineer, decompile, or attempt to extract source code from the Service;
- use the Service to send spam, run automated abuse, or interfere with its operation.
6. Fees and billing
Some features of the Service may require payment. Pricing and billing terms will be presented before any charge is incurred and may be updated from time to time. Unless otherwise stated, fees are non-refundable. Where pricing is not yet enabled, the Service may be made available at no charge during a launch or beta period; we may begin charging with reasonable advance notice.
7. Intellectual property
The Service, including its software, design, logos, and documentation, is owned by BrewerBoard and protected by applicable intellectual-property laws. Nothing in these Terms transfers ownership of the Service to you. The BrewerBoard name and logo are trademarks of BrewerBoard and may not be used without permission.
8. Third-party services
The Service relies on third-party providers (such as our hosting and authentication vendors). Your use of the Service is also subject to the terms of those providers as they apply to the data you submit through us.
9. Termination
You may cancel at any time by contacting us at the email below. We may suspend or terminate your access to the Service if you breach these Terms, if your account is dormant for an extended period, or to comply with the law. We will make reasonable efforts to give you notice before terminating, unless prompt action is required.
On termination, your right to use the Service ends. We may delete Your Content after a reasonable retention window unless you ask us to delete it sooner.
10. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or fully secure. You are responsible for verifying that the content shown on your displays is accurate before showing it to your customers.
11. Limitation of liability
To the maximum extent permitted by law, BrewerBoard and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim arising from the Service will not exceed the amount you paid us in the twelve (12) months before the claim arose, or one hundred US dollars ($100), whichever is greater.
12. Indemnification
You agree to defend, indemnify, and hold harmless BrewerBoard and its affiliates from any third-party claims arising out of your use of the Service, your violation of these Terms, or content you display on the Service.
13. Changes to these terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page and, where the change is material, give you reasonable notice (for example, by email or an in-app notice). Continued use of the Service after a change takes effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of the State of Oklahoma, United States, without regard to its conflict-of-laws principles. The state and federal courts located in Oklahoma County, Oklahoma have exclusive jurisdiction over any dispute arising from these Terms or the Service.
